Alabama,\u00a0unless stopped by the courts<\/a>, intends to strap inmate Kenneth Eugene Smith to a gurney and use a gas mask to replace breathable air with nitrogen, depriving him of oxygen needed to stay alive, on Thursday in the nation\u2019s first execution attempt with the method.<\/p>\n

\n

The Alabama attorney general\u2019s office told\u00a0federal appeals court<\/a>\u00a0judges last week that nitrogen hypoxia is \u201cthe most painless and humane method of execution known to man.\u201d But what exactly Smith, 58, will feel after the warden switches on the gas is unknown, some doctors and critics say.<\/p>\n

\u201cWhat effect the condemned person will feel from the nitrogen gas itself, no one knows,\u201d Dr. Jeffrey Keller, president of the American College of Correctional Physicians, wrote in an email. \u201cThis has never been done before. It is an experimental procedure.\u201d<\/p>\n

Keller, who was not involved in developing the\u00a0Alabama protocol,<\/a>\u00a0said the plan is to \u201celiminate all of the oxygen from the air\u201d that Smith is breathing by replacing it with nitrogen.<\/p>\n

\u201cSince the condemned person will not be breathing any oxygen, he will die,\u201d Keller said. \u201cIt is little different than putting a plastic bag over one\u2019s head.\u201d<\/p>\n

The state of Alabama has predicted in federal court filings that the nitrogen gas will \u201ccause unconsciousness within seconds, and cause death within minutes.\u201d<\/p>\n

The state plans to place a \u201cfull facepiece supplied air respirator\u201d over Smith\u2019s face. The nitrogen would be administered for at least 15 minutes or \u201cfive minutes following a flatline indication on the EKG, whichever is longer,\u201d\u00a0according to the state protocol<\/a>.<\/p>\n

The execution would be the first attempt to use a new method since lethal injection was introduced in 1982. Three states \u2014 Alabama, Mississippi and Oklahoma \u2014 have authorized nitrogen hypoxia as an execution method. Some states are\u00a0exploring new methods<\/a>\u00a0as lethal injection drugs have been difficult to find.<\/p>\n

The American Veterinary Medical Association wrote in 2020\u00a0euthanasia guidelines<\/a>\u00a0that nitrogen hypoxia is not an acceptable euthanasia method for most mammals because the anoxic environment \u201cis distressing.\u201d And experts appointed by the United Nations Human Rights Council cautioned they believe the execution method could violate the prohibition on torture.<\/p>\n

Dr. Joel Zivot, an anesthesiologist who as one of four professionals who filed the U.N. complaint that led to the warning, said Smith is at risk for seizures and choking to death on his own vomit. He said any leak under the mask could prolong the execution.<\/p>\n

\u201cA leak will do two things. It will potentially endanger people around. \u2026 Air could then get under the mask as well,\u201d Zivot said. \u201cAnd so the execution could be prolonged or maybe he might never die, he just could get injured.\u201d<\/p>\n

Much of what is recorded about death from nitrogen comes from industrial accidents \u2014 where leaks or cannister mix-ups have killed people \u2014 and from suicide attempts. The U.S. Chemical Safety and Hazard Investigation Board found 80 people were killed by nitrogen asphyxiation between 1992 and 2002.<\/p>\n

Smith was one of two men convicted of the 1988 murder-for-hire of a preacher\u2019s wife. Prosecutors said the men were paid $1,000 to kill Elizabeth Sennett, 45, on behalf of her husband, who wanted to collect on insurance. The coroner testified Sennett was stabbed repeatedly. Her husband killed himself when he became a suspect. John Forrest Parker, the other man convicted,\u00a0was executed in 2010.<\/a><\/p>\n

The victim\u2019s son, Charles Sennett Jr., said in\u00a0an interview with WAAY-TV<\/a>\u00a0that Smith \u201chas to pay for what he\u2019s done.\u201d He and other family members plan to witness the execution.<\/p>\n

\u201cAnd some of these people out there say, \u2018Well, he doesn\u2019t need to suffer like that.\u2019 Well, he didn\u2019t ask Mama how to suffer?\u201d the son told the station. \u201cThey just did it. They stabbed her \u2014 multiple times.\u201d<\/p>\n

Smith\u2019s initial conviction was overturned. He was convicted again in 1996. The jury recommended a life sentence by 11-1, but a judge sentenced Smith to death. Alabama no longer allows a judge to override a jury\u2019s sentencing decision in death penalty cases.<\/p>\n

Smith is one of few people to survive a prior execution attempt. The state attempted a lethal injection in 2022, but the prison system\u00a0called it off<\/a>\u00a0before the drugs were administered because the staff had difficulty connecting the two required intravenous lines.<\/p>\n

Smith\u2019s attorneys are asking courts to block the nitrogen execution, arguing that its unconstitutional for the state to make a second attempt to execute him and that the state\u2019s plan violates the ban on cruel and unusual punishment and at least merits more scrutiny before it is used.<\/p>\n

\u201cIt\u2019s indefensible for Alabama officials to simply dismiss the very real risks this untested method presents and experiment on a man who has already survived one execution attempt,\u201d Robin M. Maher, executive director of the Death Penalty Information Center, said.<\/p>\n

The Alabama attorney general\u2019s office noted that Smith, when previously fighting lethal injection, had suggested nitrogen as an alternative execution method. Courts require inmates challenging their execution method to suggest an alternative method.<\/p>\n

\u201cNow that the State is prepared to give Smith what he asked for, he objects,\u201d the attorney general\u2019s office said in a Monday statement.<\/p>\n

The inmate\u2019s\u00a0spiritual adviser<\/a>\u00a0said Smith is afraid of what is about to happen to him.<\/p>\n

\u201cPresently, Kenny is sickened, deeply pained and horrified at the nitrogen hypoxia experiment that is to come,\u201d the Rev. Jeff Hood, a death penalty opponent, said. \u201cDespite the darkness that has descended, he tries very hard to fill every second he might have left with as much love as he can muster.\u201d<\/p>\n

Several protests are planned in the state. A group of faith leaders delivered a petition to the state\u2019s governor on Monday asking her to halt the execution. \u201cPrisoners are not guinea pigs,\u201d the Rev. Shane Isner of First Christian Church said on the Capitol steps.<\/p>\n

Alabama Gov. Kay Ivey told The Associated Press last week that the state was ready to proceed.<\/p>\n

\u201cExecution by that method was passed in 2018,\u201d Ivey said. \u201cThe attorney general\u2019s office and the Department of Corrections has assured us that all the protocols are in place, and we will carry out that law.\u201d<\/p>\n<\/div>\n
