And they\u2019re still better off paying cash.<\/p>\n<div class=\"paywall\">\n<p class=\"wp-block-paragraph\">\u201cThey come to us because our cash price is often lower than what their insurance plan asks them to pay,\u201d Cuban <a aria-label=\"Go to https:\/\/www.fiercehealthcare.com\/regulatory\/mark-cubans-recipe-affordable-healthcare-includes-these-5-policy-changes\" href=\"https:\/\/www.fiercehealthcare.com\/regulatory\/mark-cubans-recipe-affordable-healthcare-includes-these-5-policy-changes\">told Texas House lawmakers<\/a> on Sept. 1. \u201cThat tells you something is wrong.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The billionaire Cost Plus Drugs cofounder and former <em>Shark Tank<\/em> star used the <a aria-label=\"Go to https:\/\/news.bgov.com\/bloomberg-government-news\/cuban-tells-texas-to-tighten-up-pbm-rules-drug-price-oversight\" href=\"https:\/\/news.bgov.com\/bloomberg-government-news\/cuban-tells-texas-to-tighten-up-pbm-rules-drug-price-oversight\">hearing<\/a> to prescribe five steps to fix America\u2019s <a aria-label=\"Go to https:\/\/fortune.com\/2026\/06\/20\/healthcare-affordability-cost-secure-record-low-2025\/\" href=\"https:\/\/fortune.com\/2026\/06\/20\/healthcare-affordability-cost-secure-record-low-2025\/\">healthcare affordability crisis<\/a>, which has left a record 51% of U.S. adults unable to reliably afford quality care, according to West Health-Gallup. Many of his remedies share a common active ingredient: transparency.<\/p>\n<h2 class=\"wp-block-heading\">Mark Cuban\u2019s 5-step plan to fix healthcare costs<\/h2>\n<ul class=\"wp-block-list\">\n<li><strong>Let insured patients choose the cheapest option\u2014without penalty.<\/strong> If a prescription costs $500 through insurance but $100 through Cost Plus Drugs, patients should be able to take the cheaper route and have that spending count toward their deductibles and out-of-pocket maximums. \u201cPatients should be rewarded for saving themselves and their health plan money. They shouldn\u2019t be punished for it,\u201d Cuban said. \u201cThat\u2019s how you create something healthcare desperately needs: price competition.\u201d<\/li>\n<li><strong>Standardize contracts for drug middlemen.<\/strong> Cuban wants standardized contracts for <a aria-label=\"Go to https:\/\/fortune.com\/2025\/01\/21\/pharmacy-benefit-managers-trump-cvs-cigna-unitedhealth\/\" href=\"https:\/\/fortune.com\/2025\/01\/21\/pharmacy-benefit-managers-trump-cvs-cigna-unitedhealth\/\">pharmacy benefit managers<\/a> (PBMs) and third-party administrators. Three PBMs\u2014CVS Caremark, Cigna\u2019s Express Scripts, and UnitedHealth\u2019s OptumRx\u2014handle <a aria-label=\"Go to https:\/\/fortune.com\/2025\/01\/21\/pharmacy-benefit-managers-trump-cvs-cigna-unitedhealth\/\" href=\"https:\/\/fortune.com\/2025\/01\/21\/pharmacy-benefit-managers-trump-cvs-cigna-unitedhealth\/\">roughly 80% of U.S. drug claims<\/a>. Their contracts can run hundreds of pages, making harmful terms easy to bury. \u201cI call it contractual terrorism,\u201d Cuban said. He has drafted a model PBM contract that states, cities, counties, and school districts could use as a template. \u201cJust stop making every government entity negotiate these contracts from scratch,\u201d he said. \u201cIt\u2019s a losing game for everybody.\u201d<\/li>\n<li><strong>Make pricing public wherever taxpayers foot the bill.<\/strong> Any taxpayer-funded program, including Medicare and Medicaid, should be required to disclose pricing data such as rebates, fees, guarantees, and affiliate compensation. Without that \u201cprice discovery,\u201d Cuban argued, a market can\u2019t function efficiently when one party holds all the information.<\/li>\n<li><strong>Eliminate gag clauses.<\/strong> These provisions keep employers and plan sponsors from openly discussing their contract terms, which Cuban said blocks them from comparing fees and negotiating better deals.<\/li>\n<li><strong>Give enforcement real teeth.<\/strong> Regulators could go easy on a first significant violation, Cuban said, but should hit repeat offenders with much steeper penalties. Under the current system, he said, \u201csome of these companies can make billions, get caught, pay a fine,\u201d and \u201cwrite it off more easily than I wrote off my NBA fines.\u201d He added: \u201cThat\u2019s not deterrence. That\u2019s a cost of doing business for them.\u201d<\/li>\n<\/ul>\n<h2 class=\"wp-block-heading\">Cuban\u2019s unlikely allies in Washington<\/h2>\n<p class=\"wp-block-paragraph\">Cuban\u2019s crusade on drug prices has made for strange bedfellows. In May, TrumpRx, the White House-backed discount drug site, <a aria-label=\"Go to https:\/\/fortune.com\/2026\/05\/19\/trump-rx-mark-cuban-prescription-prices-drugs-medicine\/\" href=\"https:\/\/fortune.com\/2026\/05\/19\/trump-rx-mark-cuban-prescription-prices-drugs-medicine\/\">added more than 600 generic medications<\/a> through Cost Plus Drugs, alongside Amazon Pharmacy and GoodRx. The deal put Cuban on the same side as President Donald Trump, who called him \u201ca loser\u201d during the 2024 campaign.<\/p>\n<p class=\"wp-block-paragraph\">Cuban also <a aria-label=\"Go to https:\/\/www.beckershospitalreview.com\/finance\/mark-cuban-backs-bill-to-break-up-big-insurers\/\" href=\"https:\/\/www.beckershospitalreview.com\/finance\/mark-cuban-backs-bill-to-break-up-big-insurers\/\">threw his support<\/a> in March behind the Break Up Big Medicine Act from another odd couple: Sens. Josh Hawley (R-Mo.) and Elizabeth Warren (D-Mass.). The bill would bar a single company from owning both an insurer or PBM and medical providers.
